Virtual Office PEO Employment Litigation Attorney: Northern California

We are working with one of the oldest and largest management side, labor and employment law firms in the country. The firm seeks an experienced Labor & Employment Litigation Attorney (7+ years) to join its Virtual Office team, as Special Counsel, to support a dedicated Professional Employment Organization (PEO) client. This non-partnership track role is ideal for an attorney who enjoys owning the day-to-day management of employment matters and who can deliver consistent, high quality service to a sophisticated PEO client, its customers, and its insurance carrier. The hired attorney will represent such clients throughout California but, mainly, in Northern California. The role is remote, except for necessary or desirable appearances, in person, at depositions; court hearings and trials; administrative hearings; mediations; arbitrations; conferences; and other such litigation events. Expertise handling employment law matters and the ability to work independently in a remote setting are essential. Preferred qualifications include prior practice in a law firm, prior experience with EPLI matters, and prior experience representing PEOs. It requires travel throughout Northern California, particularly, but also to other parts of the state. The attorney hired will collaborate with firm partners and an attorney team and benefit from the support of a paralegal team and a shared secretarial pool within the firm’s Virtual Office. The Special Counsel PEO Employment Litigation Attorney role requires efficient, high quality legal work and offers the challenge of a full-cycle litigation practice; however, it allows the attorney serving in it increased flexibility, including options re billable hours expectations, which the attorney, individually, participates in setting in dialogue with appropriate firm personnel. The position imposes no business development pressure, allowing the attorney filling this role to concentrate on providing exceptional legal services without the burden of additional non-billable hour demands. Salary for the firm’s Special Counsel PEO Employment Litigation Attorney role is $190,000-$205,000, with the actual base pay determined by factors such as the hired attorney’s own selected billable hours target and the attorney’s actual employment litigation experience, skills, and qualifications. RESPONSIBILITIES

  • Handling from inception through resolution a high volume docket of administrative charges, EPLI covered claims, attorney demand letters, and employment litigation, primarily including single-plaintiff litigation, such as class actions, PAGA cases, et al.
  • Representing clients both remotely and in person, as may be necessary or desirable, in state and federal court proceedings, administrative proceedings, depositions, mediations, arbitrations, hearings, conferences, and other litigation-related events
  • Developing case strategy
  • Drafting and reviewing pleadings and motions
  • Conducting and defending depositions
  • Supervising and mentoring attorneys and legal staff
  • Coordinating closely and congenially with partners, associates, paralegals, and shared support teams

QUALIFICATIONS

  • JD from an ABA accredited law school
  • Licensure in good standing, as well as residence, in California
  • Expertise handling employment law matters
  • Experience with matters covered by EPLI (preferred)
  • Experience with PEO representation
  • Comfort with in-person advocacy and client representation, as well as willingness to provide it, when circumstances require physical presence or render it desirable
  • Dedication, over the long-term, to full-time PEO representation
  • Consistent availability
  • Ability to work independently in a remote setting
  • Ability to travel throughout Northern California and, as may be necessary or desirable, to other parts of the state
  • Seven or more years (7+) of experience in employment law and litigation
  • Experience practicing in a law firm (preferred)
