About the position The Field Counsel position at Allstate is a remote role based in Michigan, designed for an experienced legal professional to represent the company in various insurance defense matters and litigation. The ideal candidate will have a strong background in combating fraud within the insurance industry, particularly in No-Fault and Special Investigative Unit (SIU) contexts. This role requires a proactive approach to defending against fraudulent claims and initiating affirmative actions, including RICO-based litigation. The attorney will be responsible for attending hearings, arbitrations, mediations, and trials in both state and federal courts, necessitating strong legal writing skills and the ability to conduct thorough legal research and drafting. In this position, the attorney will partner closely with the Claims/SIU department to strategize and defend against fraudulent claims. Responsibilities include preparing and filing fraud actions, developing litigation strategies for complex cases, and managing No-Fault litigation related to fraud. The attorney will also be tasked with drafting motions, memorandums, and other legal briefs, as well as preparing for and conducting depositions and examinations under oath (EUOs). Court appearances, including matter management conferences and hearings, are essential components of the role, requiring the attorney to be well-versed in both state and federal court procedures. The successful candidate will possess a juris doctorate and a license to practice law in Michigan, along with at least seven years of relevant experience in SIU/No-Fault matters. Federal court experience is strongly preferred, as is a background in managing complex litigation cases. The role demands strong analytical skills, the ability to influence and coach others, and a commitment to maintaining confidentiality and ethical standards. The attorney will also be expected to provide legal opinions to the Claims department and negotiate settlements as necessary, making this a multifaceted and dynamic position within the legal team at Allstate. Responsibilities • Partner with Claims/SIU department to defend against fraudulent claims submitted against the Company in No-Fault and other matters , • Prepare, file and litigate fraud actions on behalf of the Company including RICO and other Affirmative Actions , • Prepare litigation strategies in complex matters , • Defend the Company in No-Fault litigation related to fraud , • Review file assignments and strategize for resolution , • Propound discovery and draft motions, memorandums and other legal briefs as required , • Prepare for and conduct depositions and EUOs , • Attend arbitrations, mediations, and trials including expert witnesses , • Prepare and conduct court appearances (matter management conferences, hearings, status conferences, etc.) in both State and Federal Court , • Draft pre and post-trial motions in Federal and State Courts , • Negotiate settlement and draft related documents , • Prepare and argue appeals , • Provide legal opinions to Claims Requirements • Possesses a juris doctorate and a license to practice law in MI , • Federal Court admission , • 7+ years related experience typical in SIU/No-Fault , • Federal Court experience strongly preferred , • Ability to manage Complex Litigation cases , • Computer skills, including MS Office suite, used in or related to the tasks performed , • Exercises discretion and maintains confidentiality of sensitive information , • Demonstrates ethics and integrity , • Has relevant experience within a reputable law firm or an in-house legal department for a mid- to large-sized organization , • Insurance-industry experience preferred , • Knowledge of legal holds and discovery processes , • Budget management skills , • Project management skills , • Able to interact with all levels of personnel and supervise/oversee the work of more junior resources , • Utilizes subject matter expertise to coach and guide less experienced team members Nice-to-haves • Experience in insurance defense , • Familiarity with health care laws applicable to SIU matters , • Experience in drafting and negotiating complex legal documents Benefits • Flexible work environment , • Diversity and inclusion initiatives , • Opportunities for professional development , • Competitive compensation package Apply Job!
